NextMove Global – Privacy Policy

NextMove Global Pty Ltd (“NextMove”, “we”, “our”, “us”) is committed to protecting the personal information of all individuals associated with our operations, including job seekers, remote talent, employers, staff, and contractors across all business divisions:

1.2. This Privacy Policy outlines how we collect, store, use, and disclose personal information in
accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth), and
other relevant laws where applicable including UAE privacy law for Gulf operations.


1.3. By engaging with us—whether as a candidate, employer, service provider, or visitor to our digital platforms—you consent to our handling of personal information in accordance with this policy.

1. Introduction

2.1. This policy applies to:

  • All candidates (local, offshore, remote, permanent, temporary, contract, or labor hire)

  • Employers or client businesses that use our workforce, migration, or remote staffing services

  • Our staff, including part-time, full-time, interns, and subcontractors

  • Visitors to our websites and users of our platforms, including our applicant tracking system (Manatal)

 

2.2. This policy covers all data processing activities related to:

  • Recruitment and placement (including onboarding and payroll processing)

  • Labor hire and employment services

  • Talent mobility and global migration services

  • Remote work facilitation and ATS-supported engagement

  • Communication, marketing, and analytics

2. Scope of the Policy

3.1. Depending on your relationship with us (e.g., candidate, client, employee), we may collect the following types of information:

  • Identifying details: name, date of birth, gender, nationality

  • Contact information: email, phone number, address

  • Employment data: CVs/resumes, employment history, referees, qualifications, certifications

  • Compliance information: right to work, visa/citizenship status, police checks, licensing or registration (e.g., WHS, CPD, insurance for contractors)

  • Financial information: bank details, TFN, payroll data, superannuation details

  • Digital information: IP address, browser type, usage logs, interactions on Manatal or our website

  • Health or sensitive data: where required by law or client for role suitability (e.g., medical fitness for work)

  • Emergency contacts and next of kin

3.2. Where legally required or operationally relevant, we may also collect:

  • Video or audio recordings from interviews or onboarding sessions

  • Behavioral or psychometric assessment data where consent is provided

  • Immigration or relocation details for mobility services

3. Personal Information We Collect

4.1. We collect personal information through various means, including:

  • Directly from you (via online forms, email, phone, interviews, or face-to-face)

  • From third-party recruitment partners, referees, and previous employers

  • Through use of our digital tools (e.g., Manatal ATS, online application forms)

  • From publicly available sources (e.g., LinkedIn, job boards)

  • From government, licensing, or background-checking bodies

4.2. Automated Collection via ATS: Our Applicant Tracking System (Manatal) may collect data when you interact with our online job listings, submit applications, or create a candidate profile.

4. How We Collect Information

5.1. We collect and use your information for the following purposes:

  • To provide recruitment, job placement, and employment services

  • To manage onboarding, payroll, and contract obligations

  • To ensure compliance with laws, workplace health and safety, visa conditions, and licensing requirements

  • To connect you with suitable employment or contract opportunities

  • To communicate updates, interview schedules, and feedback

  • To maintain records and conduct audits

  • For internal data analysis, reporting, and service improvement

  • To operate, maintain, and enhance our ATS and digital services

5. Use of Personal Information

6.1. Internal Disclosures
We may share your personal information with different divisions of NextMove Global Pty Ltd where reasonably required, including NextMove Workforce Australia, NextMove Global Mobility, NextMove Careers Gulf Connect, and NextMove Remote Talent Hub.


6.2. External Disclosures
We may disclose your personal data to third parties for the purposes outlined in Clause 5,
including:

  • Host employers and client companies for placement or work allocation

  • Referees, previous employers, and professional bodies for background checks

  • Service providers (e.g. IT support, payroll processors, WHS advisors)

  • Legal, regulatory, or migration agents (if part of our integrated service offering)

  • Financial institutions and superannuation funds for payroll setup

  • Government departments or regulators (e.g., ATO, Home Affairs, Fair Work)

6.3. ATS System Disclosures
Your personal data may be shared within the Manatal ATS system to manage recruitment workflows and match profiles with job opportunities.


6.4. Required by Law
We may disclose information where required to comply with legal obligations, court orders, or law enforcement investigations.

6. Disclosure of Personal Information

7.1. Given the global nature of our operations—including Gulf and remote workforce services—we may transfer your personal information overseas. This includes using cloud storage hosted in data centres outside Australia, communicating and processing data with offshore employers and clients (such as those in the UAE, Saudi Arabia, Pakistan, or other Gulf countries), and collaborating with NextMove Global remote teams based offshore.


7.2. Where personal data is transferred internationally, we take all reasonable steps to ensure that your information is handled securely and in compliance with applicable privacy standards.

7. Overseas Disclosure and Transfers

8.1. We strive to ensure that the personal information we hold is accurate, up-to-date, and complete.

 

8.2. We take reasonable steps to protect personal information from misuse, interference, loss, unauthorized access, modification, or disclosure. These steps include secure cloud-based storage with restricted access, the use of multi-factor authentication and role-based access controls, regular data backups and cybersecurity measures, and training for staff and subcontractors in privacy compliance.


8.3. We apply privacy and security protocols to third-party systems we use, including the Manatal ATS platform.

8. Data Quality and Security

9.1. We retain personal information only for as long as necessary to fulfil the purposes for which it was collected or as required by law. This includes retaining employment and payroll records for seven years to meet legal obligations, keeping candidate records for two years if the individual is not placed (or longer if placed for audit and compliance purposes), and storing marketing or communication preferences until the individual opts out. When information is no longer required,
we securely delete or anonymise it through permanent deletion of digital files, secure erasure of
ATS candidate records, or destruction of physical documents.

9. Data Retention and Disposal

10.1. You have the right to request access to the personal information we hold about you and to request corrections if any data is inaccurate, outdated, or incomplete. Requests can be made by emailing our Privacy Officer at privacy@nextmoveglobal.com.au. We generally respond within 30 days and may require verification of your identity. In certain situations, access may be refused if it would be unlawful, affect another person’s privacy, or involve confidential business information.

10. Access and Correction

11.1. You have several rights regarding your personal information under the Privacy Act 1988 (Cth) and, where applicable, international privacy laws. These include:

  • The right to access your personal information

  • The right to request correction or updates

  • The right to withdraw consent (where processing is based on consent)

  • The right to request deletion of data (subject to legal and operational limitations)

  • The right to object to direct marketing

  • The right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC)

 

11.2. Where our services are offered to individuals in other jurisdictions (e.g., EU under GDPR or
UAE under DIFC laws), we will honour those rights in accordance with local laws.

12.1. Our websites and digital services (including Manatal-powered candidate portals) may use cookies and similar technologies to improve your experience and gather analytics.


12.2. Cookies used may include:

  • Session cookies (to enable essential site functionality)

  • Persistent cookies (to remember user preferences)

  • Analytics cookies (e.g., Google Analytics)

  • ATS tracking cookies (to monitor application progress via Manatal)

12. Cookies and Digital Tracking

13.1. We may use your personal information to send you marketing materials about our services, job alerts, industry news, or updates related to our divisions:

  • Job and project opportunities via NextMove Workforce Australia and Remote Talent Hub

  • Migration and global relocation support via NextMove Global Mobility

  • Employer partnerships and workforce solutions via Gulf Connect

  • Skills development and job-readiness communications via all divisions

  • Email, phone, or SMS

  • In-app messaging through our ATS or recruitment portal

13. Direct Marketing and Communications

Our digital platforms may provide access to or integrate with third-party services such as background checking tools, visa support websites, or training partners. While we aim to link only to reputable providers, we do not take responsibility for how these external parties collect or manage your personal information. We strongly recommend reviewing their individual privacy policies before sharing any personal data on their platforms.

14. Third-Party Links and Integrations

If you have concerns about how your personal information has been handled by NextMove Global, you are encouraged to raise your complaint directly with our Privacy Officer. To do this, please email us at privacy@nextmoveglobal.com.au with details of your concern, including your contact information. We will confirm receipt within five business days and aim to provide a full response within thirty calendar days following an internal review. If you're not satisfied with our resolution, you may contact the Office of the Australian Information Commissioner or the relevant data protection authority in your country.

15. Complaints and Privacy Concerns

16.1. We use Manatal as our primary Applicant Tracking System (ATS) to manage recruitment and candidate engagement.


16.2. Manatal helps collect applications, manage communication with clients and candidates, and track job-matching progress.


16.3. Candidate data stored in Manatal is securely hosted and governed by international privacy standards.

 

16.4. By applying through our platform, candidates agree to the terms and conditions of Manatal.

 

16.5. Candidates may request to update or delete their data from the system by contacting us.

16. Use of the Applicant Tracking System (Manatal)

17.1. Remote workers engaged via the Remote Talent Hub may have their data shared with employer clients and internal managers.


17.2. Information may also be shared with software providers for time tracking, payroll, or performance monitoring.

 

17.3. We take reasonable steps to ensure that all cross-border data transfers are secure and compliant with relevant laws.


17.4. Remote workers have full access to their data rights, including the ability to request access, updates, or withdrawal of consent.


17.5. Personal information is used only for lawful and necessary operational or compliance purposes.

17. Privacy for Remote and Offshore Talent

18.1. Candidates engaged through Gulf Connect may have their personal data shared with clients or regulators in the Gulf region.


18.2. This may include countries such as the United Arab Emirates, Saudi Arabia, Qatar, Bahrain, Oman, or Kuwait.


18.3. These jurisdictions may not offer the same level of privacy protection as Australia or the EU.

 

18.4. We take reasonable steps to ensure that data shared across borders is limited in scope and securely transmitted.

18.5. By submitting applications through Gulf Connect, candidates consent to these international data transfers.

18. Gulf Connect Candidates – Special Considerations

19.1. All employees, assistants, and subcontractors are required to sign privacy and confidentiality agreements before handling personal data.


19.2. They are provided access to personal information only as required for their duties.


19.3. Only authorised tools and platforms, such as Manatal or Microsoft 365, are used for data access and processing.

19. Subcontractors and Internal Personnel Access

20.1."NextMove Global", "we", "us", or "our" refers to NextMove Global Pty Ltd, including its operational divisions:

  • NextMove Workforce Australia

  • NextMove Global Mobility

  • NextMove Careers Gulf Connect

  • NextMove Remote Talent Hub

20.2. "Personal information" means any information or opinion about an identified individual, or an individual who is reasonably identifiable.


20.3. "Sensitive information" includes information about an individual's race, ethnic origin, political opinions, health, or criminal history, and is handled with higher safeguards.


20.4. "ATS" refers to the Applicant Tracking System used by NextMove Global for candidate data and recruitment workflows (currently Manatal).


20.5. "Candidate" refers to any job seeker, applicant, remote worker, contractor, or individual being assessed for a placement.


20.6. "Client" or "Employer" means an organization, business, or representative engaging NextMove Global to source, supply, or manage workforce services.

20. Definitions

21.1. We may update this Privacy Policy from time to time to reflect:

  • Changes in law or regulation

  • Updates to technology, platforms, or services used (e.g., change in ATS)

  • Expansion of our service offerings

  • Internal review of privacy practices

21.2. Significant changes will be communicated through our website and, where appropriate, via email to affected users.
